These Terms of Service ("Terms") govern your use of the Canada Family Mediation website and related professional services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

1. Overview of Services

Canada Family Mediation is a not-for-profit organization providing professional family mediation, arbitration, parent coordination, child voice services, collaborative family law support, financial separation guidance, family counseling, and related services to individuals and families across Ontario.

2. Eligibility

To engage our services, you must be at least 18 years of age or the legal age of majority in your jurisdiction. By using our website or booking a consultation, you represent that you meet this requirement.

3. Account Registration

Certain features of our platform, including blog access and event registration, may require account creation. You agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Nature of Services

Canada Family Mediation provides professional mediation and related services. Our practitioners are certified mediators, arbitrators, and child development specialists. Our services do not constitute legal advice. Clients are encouraged to seek independent legal counsel before signing any agreement reached through mediation or arbitration.

Participation in mediation is voluntary. Either party may withdraw at any time prior to the signing of a final agreement. Arbitration decisions are binding and subject to appeal only as provided under Ontario's Arbitration Act.

5. Confidentiality

All communications, disclosures, and documents shared during mediation sessions are strictly confidential and may not be used in subsequent legal proceedings except as required by law. Clients agree to maintain the confidentiality of the mediation process and all information disclosed therein.

Exceptions to confidentiality include mandatory reporting obligations under Ontario law, including situations involving risk of harm to a child or vulnerable person.

6. Fees & Payments

Service fees are presented at the time of engagement and are payable according to the schedule agreed upon at intake. Fees are charged on an hourly basis unless a fixed-fee package has been agreed upon. Clients are responsible for fees incurred regardless of whether a final agreement is reached.

Cancellations must be made at least 48 hours in advance to avoid a cancellation fee. Canada Family Mediation reserves the right to adjust its fee schedule with reasonable notice.

Our liability is limited to the fees paid for the specific service giving rise to a claim.

You agree to indemnify and hold Canada Family Mediation, its practitioners, and staff harmless from any claims, liabilities, damages, or expenses arising from your use of our website or services, or your violation of these Terms.

We may update these Terms from time to time to reflect changes in our services or applicable law. Updates will be posted to this page with a revised effective date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Ontario, or resolved through arbitration where applicable.
